Salary negotiation in 2026

Every claim in the video, with its source, its method and its weakness — including the one number where the sources contradict each other.

1. Our own measurement

Taken 27 August 2026: the top 10 YouTube results for salary negotiation, then each video's publication date, lined up against the dates pay transparency laws took effect.

Share of the top 10 published beforeWhat changed on that date
2 of 101 Jan 2021 — Colorado, first law requiring a range in the posting
4 of 101 Nov 2022 — New York City
4 of 101 Jan 2023 — California (SB 1162) and Washington
9 of 107 Jun 2026 — EU directive 2023/970

Median age of the ranking: 45.9 months. One video in ten is under twelve months old.

What is wrong with it. YouTube's ranking is personalised; ours is the signed-out US ranking. And more important: being older than a law does not make advice wrong. Most of it still works. What the measurement shows is that the starting assumption changed for part of the audience — not that the advice is bad. The video says exactly that.

2. What changed in the United States

Eleven states plus the District of Columbia require a good-faith pay range in the job posting: California, Colorado, Hawaii, Illinois, Maryland, Massachusetts, Minnesota, New Jersey, New York, Vermont, Washington. Three more — Connecticut, Nevada, Rhode Island — require it on request or before an offer.

Two dated changes in 2026: California SB 642 (1 Jan 2026) redefines "pay scale" as a good-faith estimate and extends the recovery period to six years; Rhode Island requires written pay notice for new hires from the same date.

Weakness. This list comes from law firms and payroll vendors — serious, but parties with something to sell. The dates are each verifiable in the statutes; we have not verified all of them at source. So the video cites the count and the two 2026 changes, not an exhaustive list presented as certified.

3. What changed in Europe — and the disputed number

Directive (EU) 2023/970, transposition deadline 7 June 2026, confirmed not postponed by the European Commission. It gives the applicant the right to know the pay, or at least a range, before the first interview, and forbids the employer from asking about salary history.

How many member states actually transposed it? The sources disagree — so we went to the register rather than pick a side.

Why the numbers differ, and we say so in the video. Notifying measures is not the same as having fully transposed — a country can notify a partial transposition. The two counts measure different things.
Weakness of our own reading: the EUR-Lex page was read by an automated tool. The register is the authority, not our transcription. The video says "12 have notified measures", citing the register, and does not claim to settle the number of complete transpositions.

4. What we deliberately left out
